Epiq Expert to Review Choice of Law Considerations Affecting Nationwide Class Action Settlements

The session will be held at Clyde & Co LLP, San Francisco, on Friday, June, 22 at 4:15 p.m. PDT.

“Scrutiny of class settlements is increasing and it is more important than ever to document the rationale for every part of an agreement, from notice to distribution,” said Azari. “It is crucial that how notice is to be given, and its form and content, be thoughtfully explained so that no one can reasonably assert that the class will not be apprised of their rights.”

Recently, the Ninth Circuit issued a decision in In re: Hyundai and Kia Fuel Economy Litigation rejecting a district court’s approval of a nationwide settlement because the district court failed to apply California’s choice of law rules in assessing the impact of varying state laws and the possibility that class members in some states may have stronger or weaker claims than those in other states. 

This panel will:

  • Examine the decision and evaluate the challenges it poses to class and defense counsel in negotiating and obtaining court approval for a nationwide class action settlement
  • Explore strategies counsel can employ in getting a nationwide settlement certified after In re Hyundai
  • Share strategies for dealing with differences of legal opinion between class counsel and defense counsel regarding whether it is appropriate to apply a single state’s law to a nationwide class
  • Identify factors the district courts are likely to consider in approving a nationwide class settlement or certifying a nationwide class
